Terms of Service

By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. If you use SUAN for an organization, you represent that you have authority to accept these Terms for that organization.

You must be at least 13 years old and legally able to enter into this agreement. If you have not reached the age of majority where you live, you may use the Service only with permission from a parent or legal guardian.

You may need to sign in by email or through a supported provider. You are responsible for the accuracy of information you provide, for protecting access to your email and sign-in providers, and for activity under your account. Notify us at legal@suan.fm if you believe your account has been compromised.

You may not share, sell, transfer, or create accounts through automated or deceptive means. We may require you to verify account information or choose a different handle.

SUAN lets people create, personalize, send, save, and play tapes and related messages, profiles, and music selections. Some content can be public, while other content is intended for selected recipients. You are responsible for checking your visibility and sharing choices before publishing or sending content.

Features may change over time. We may add, remove, limit, suspend, or discontinue all or part of the Service, including to protect users, comply with law, or maintain security and reliability.

You retain ownership of content you create or upload. You give SUAN a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt for technical formatting, display, perform, and distribute that content only as needed to operate, secure, improve, and provide the Service according to your visibility and sharing choices. This license ends when the content is deleted from our systems, except where continued retention is described in these Terms or required by law.

You represent that you have the rights and permissions needed for your content and that our use of it as described in these Terms will not violate another person’s rights or the law. You are responsible for your content and for the people with whom you share it.

Music search results, metadata, artwork, previews, and playback may be supplied by third parties such as Spotify. SUAN does not grant you rights to copy, download, redistribute, or commercially exploit music or third-party materials. Your use of social sign-in, embedded players, links, or other third-party services is also subject to that provider’s terms and privacy policy. We are not responsible for third-party services or content.

You may not use the Service to:

• break the law or encourage illegal, fraudulent, or harmful activity;
• infringe intellectual property, privacy, publicity, or other rights;
• harass, threaten, exploit, impersonate, defame, or deceive another person;
• publish sexual content involving minors or content that facilitates abuse;
• send spam, unwanted promotions, or repeated unwanted messages;
• upload malware or interfere with, probe, or bypass security or access controls;
• scrape, crawl, or access the Service by automated means without our permission;
• reverse engineer the Service except where the law expressly allows it; or
• help another person do anything prohibited by these Terms.

Our Privacy Policy explains how we handle personal information. By using the Service, you acknowledge those practices. Do not provide another person’s personal information unless you have a lawful reason and any permission needed to do so.

We may review reports and may restrict visibility, remove content, limit features, suspend accounts, or terminate access when we reasonably believe these Terms have been violated or action is needed for safety, legal compliance, or Service integrity. We are not obligated to monitor all content and do not endorse user content.

If you believe content violates your rights, send enough detail for us to identify and review it to legal@suan.fm.

You may stop using the Service at any time and may request account deletion by emailing legal@suan.fm. We may suspend or end your access as described above.

If a recipient has already claimed a gift tape, the tape and a limited, frozen snapshot of the creator identity shown when it was sent may remain available to that recipient after the creator deletes their account. Provisions that by their nature should survive termination will survive, including provisions about ownership, third-party services, disclaimers, liability, and enforcement.

The Service, including its software, design, branding, and materials other than user content and third-party materials, is owned by or licensed to suan.fm and is protected by applicable laws. These Terms give you a limited, revocable, non-transferable right to use the Service for its intended purpose; they do not transfer ownership to you.

If you send suggestions or feedback, you allow us to use them without restriction or payment, but you are not required to provide feedback.

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” suan.fm disclaims implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, secure, error-free, or that content will always be preserved. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

To the fullest extent permitted by law, suan.fm and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities, arising from or related to the Service. Nothing in these Terms limits liability that cannot lawfully be limited, including where applicable liability for fraud, willful misconduct, or death or personal injury caused by negligence.

We may update these Terms to reflect changes to the Service, law, or our practices. We will post revised Terms with a new effective date and provide additional notice when required. If you continue using the Service after revised Terms take effect, you accept the revised Terms. If you do not agree, you must stop using the Service.

If a provision of these Terms is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our permission. We may transfer them as part of a reorganization, sale, or transfer of the Service. These Terms and the Privacy Policy are the entire agreement between you and suan.fm about the Service.
